What is Design Registration?

Design Registration under the Designs Act, 2000 protects the visual features of a product - its shape, configuration, pattern, ornament, or composition of lines or colors that gives it a unique appearance. It protects the aesthetic aspect, not the functional aspect.

A registered design gives the owner exclusive rights to apply the design to the article for which it is registered. Any unauthorized use of the registered design constitutes piracy and is actionable in court with damages.

The design must be new and original - meaning it should not have been previously published or used in India or abroad before the date of application. The protection is for 10 years, extendable by another 5 years (total 15 years maximum).

Frequently Asked Questions

The visual features of an article can be registered - including shape, configuration, pattern, ornament, or composition of lines or colors. However, a design must not be purely functional. Works of architecture, maps, artistic works protected under copyright, and designs contrary to public order cannot be registered.
Design registration is initially valid for 10 years from the date of registration. It can be extended for one further period of 5 years, making the total maximum protection period 15 years. After 15 years, the design enters the public domain and anyone can use it freely.
